On April 8, 2017, at 7:11 p.m., members of the East Algoma Ontario Provincial Police (OPP) responded to a family dispute call on Bailey Lane in Elliot Lake.
The complainant called police to report that he was assaulted and threatened with a baseball bat. When OPP arrived on scene, they located two males who were yelling obscenities at each other and who refused to co-operate with officers. Police arrested both men.
As a result of the investigation, Dwayne NEWTON, 48 years of age, of Elliot Lake, Ontario, was issued a Provincial Offence Notice for being intoxicated in a public place, contrary to section 31(4) of the Liquor Licence Act (LLA). He was held in police custody overnight and released the next morning.
Desi NEWTON, 38 years of age, of Elliot Lake, Ontario, was charged with:
Being intoxicated in a public place, contrary to section 31(4) of the Liquor Licence Act (LLA)
Fail to comply with Recognizance, contrary to section 145(3) of the Criminal Code (CC)
This accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake, Ontario on May 2, 2017.
